2. Services: OmniaFix provides customer service solutions to e-commerce businesses, including but not limited to customer support via email, chat, and phone, order processing, returns management, and dispute resolution assistance.

3. Applicability: These terms apply to all offers, agreements, and service deliveries by OmniaFix unless explicitly agreed otherwise in writing.

4. Offers and Agreements: Offers are non-binding and valid for 14 days unless stated otherwise. An agreement is established once the offer is confirmed in writing or by email by the client.

5. Pricing and Payment:

• All prices are exclusive of VAT.
   

• Payment term is 14 days after the invoice date.
   

• In case of late payment, Omnia Fix reserves the right to suspend service delivery until full payment is received.
   

6. Client Responsibilities: The client is responsible for providing accurate and complete information necessary for the proper performance of the services in a timely manner.

 

7. Liability: Omnia Fix is not liable for indirect damages such as consequential damages, lost profits, or missed savings. Our liability is in any case limited to the amount paid by our insurer or, if no insurance payment is made, to the invoice amount related to the assignment.

8. Confidentiality: We treat all business information from our clients confidentially and will not share it with third parties without prior consent, unless required by law.

9. Force Majeure: Omnia Fix is not obligated to fulfill any obligation if prevented due to circumstances beyond our control, such as internet disruptions, pandemics, or labor strikes.

 

10. Termination: Both parties may terminate the agreement in writing with a notice period of one month, unless otherwise agreed.

 

11. Intellectual Property: All intellectual property rights related to materials developed or used by Omnia Fix remain the property of Omnia Fix unless agreed otherwise in writing.

 

12. Data Protection: Omnia Fix complies with applicable data protection laws (GDPR). We process client and end-customer data solely for the purpose of service delivery and take appropriate technical and organizational measures to protect personal data.

 

13. Applicable Law and Disputes: These terms are governed by Dutch law. Any disputes will be submitted to the competent court in Rotterdam, the Netherlands.

 

14. Amendments to Terms: Omnia Fix reserves the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes by email or via our website.
